The products offered under Roman Living are made of glass fiber reinforced stucco plaster. A certain risk of breakage cannot be avoided despite good packaging, padding and instructions from the carrier. The following illustration therefore supplements our terms and conditions of sale with the specification of reasons for withdrawal due to poor product quality.
IMPORTANT: Please check the goods for damage immediately upon receipt, even before you confirm the undamaged and complete receipt of the goods to the shipping company. We cannot subsequently repair transport damage if the receipt of the goods has been confirmed to the carrier as complete and undamaged.
Specimens whose unrestricted usability is guaranteed have been marked in green: small chips or bumps on the corner pieces can be caused either by machine cutting or transportation. Stucco moldings are usually cut to size or mitered during installation. Visual defects, as shown in picture 2 from the left, also do not limit the usability. The stucco strips are painted after installation; color deviations, including from the plaster itself, cannot be avoided as this is a natural product. Materials with these characteristics will not be reworked per se, unless otherwise specified in individual cases.
Items marked in red are those whose unrestricted usability is no longer guaranteed: large bumps, e.g. broken off parts or fractures that destroy the stucco part. Materials with this type of damage do not meet our quality standards and will be reworked free of charge. Consequences of the revocation
If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.
We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case no later than 14 days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the deadline of 14 days.
You shall bear the direct costs of returning goods that can be sent by parcel post as well as the direct costs of returning goods that cannot be sent by parcel post.
You only have to pay for any loss of value of the goods if this loss of value is due to the handling of the goods which is not necessary for the inspection of the condition, properties and functioning of the goods.
Reasons for exclusion or expiry
The right of withdrawal does not apply to contracts
a) for the delivery of goods which are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. This includes all types of stucco moldings, profiles, cornices, columns and pilasters that are made to measure or shaped for the customer. Orders that exceed a goods value of €1500.00 are produced for the consumer as custom-made products.
For orders with a total value of more than €1500, the principle therefore applies that the item(s) ordered is/are produced as custom-made products for the customer. Custom-made products can also be produced, for example, if the customer specifies dimensions, shape specifications or specific delivery dimensions. The custom-made products described are excluded from the right of withdrawal within the meaning of the Distance Selling Act.
b) for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;
c) for the delivery of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which can be delivered at the earliest 30 days after the conclusion of the contract and the current value of which depends on fluctuations on the market over which the entrepreneur has no influence;
d) for the delivery of newspapers, periodicals or magazines with the exception of subscription contracts.
Other exceptions to the right of withdrawal:
The provisions regarding the right of withdrawal and return do not apply to transactions with merchants. If the contracting party is a merchant or clearly acts in the interest of a business, the law of the Federal Republic of Germany shall apply exclusively.

– for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal was removed after delivery;
– for the delivery of goods if these have been inseparably mixed with other goods after delivery due to their nature;
